Privacy Policy

Mind Technologies Inc., which owns and operates the HAPPILY Mobile and Web Apps, is hereinafter referred to as the “COMPANY.”  The HAPPILY Mobile and Web Apps are hereinafter referred to as the “App.”

COMPANY may change this Privacy Policy from time to time, and will notify users or subscribers by revising the date at the top of this policy statement.

This Privacy Policy explains how COMPANY collects, uses, and discloses information about users and subscribers of the App, and other on-line services.

COMPANY and the App does not ask for user’s or subscribers’ names, email addresses, phone numbers, addresses, or any information that can directly disclose the real identity of users or subscribers.

COMPANY and the App does not collect or save any personal identifiable information (PII), that is any representation of information that permits the identity of an individual to whom the information applies, to be reasonably inferred by either direct or indirect means, such information including social security numbers, driver's license numbers, alien registration numbers, financial or medical records, biometrics, country of origin, or criminal history. 

While any individual can contact the COMPANY via its email address, phone number, or by sending a document to the registered office of the COMPANY, the COMPANY does not ask individual to identify his/her username or PIN if individual is a user or subscriber of the App.

In summary, while the COMPANY assumes that some real human is a user of its App, it or the App does not know who that human is.

Several types of information is collected, but the information is not about the identity of any specific individual user, and cannot be linked to any specific individual user.  The following sections describe the types of information collected.

Information users or subscribers provide to the App. 

COMPANY collects information when users or subscribers register for an account, participate in interactive features, fill out a form or a survey, participate in a contest or promotion, make a purchase, request customer support, or otherwise communicate with us. The information users or subscribers may provide includes only a user defined username, and a user defined PIN, goals, moods and reflections, feedback, survey responses, and other information about users or subscribers included within users or subscribers’ messages to COMPANY, which does not include user’s name, email address or financial information.

Other information about users or subscribers’ use of the App

When users or subscribers use the App’s features and services, COMPANY collects the following information about users or subscribers:

• Usage Information: Whenever users or subscribers use our Services, COMPANY collects usage information, such as the sessions users or subscribers use, videos users or subscribers view or content users or subscribers listen to, what screens or features users or, subscribers access, and other similar types of usage information.

• Log Information: COMPANY collect standard log files when users or subscribers use our Services, which include the type of COMPANY’s browser users or subscribers use, App version, access times and dates, users or subscribers’ IP address, and the page users or subscribers visited and navigated while using the App.  

• Device Information: COMPANY collects information about the computer or mobile device users or subscribers use to access our Services, including the hardware model, operating system and version, device identifiers set by users or subscribers’ device operating system, and mobile network information (like users or subscribers’ connection type, carrier and region).

COMPANY uses the information collected for the following purposes:

• Provide, maintain and improve App services, including debugging to identify and repair errors, and developing new products and services;

• Process transactions and fulfill orders;

• Send users or subscribers transactional or relationship messages, such as receipts, account notifications, customer service responses, and other administrative messages;

• Communicate with users or subscribers about products, services, and events offered by COMPANY and others, request feedback, and send news, gifts or other information COMPANY thinks will be of interest to users or subscribers.

• Monitor and analyze trends, usage, and activities in connection with our Services;

• Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of COMPANY and others, including to enforce our agreements and policies. 

• Comply with the law, such as by processing transactional records for tax filings and other compliance activities;

• Personalize users or subscribers’ App experience. 

• Facilitate contests, COMPANY’s sweepstakes, and promotions and process and deliver entries and rewards.

COMPANY shares information about users or subscribers as follows;

With companies and contractors that perform services for us, including email service providers, payment processors, fraud prevention vendors and other service providers;

• In response to a request for information if COMPANY believes disclosure is in accordance with, or required by, any applicable law or legal process, including court order, subpoena, or other lawful requests by public authorities to meet national security or law enforcement requirements;

• If COMPANY believe users or subscribers’ actions are inconsistent with our user agreements or policies.  If COMPANY believes users or subscribers have violated the law, or to protect the rights, property, and safety of COMPANY or others;

• In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;

• Between and among COMPANY and our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership; and

• With users or subscribers’ consent or at users or subscribers’ direction.  For instance, users or subscribers may choose to share actions users or subscribers take on our Services with third-party social media services.

• COMPANY also shares aggregated or other information not subject to obligations under the data protection laws of users or subscribers’ jurisdiction with third parties.  For example, COMPANY sometimes share aggregate information with research organizations to help facilitate their research.

COMPANY is based in the United States and processes information in the United States, which may not provide equivalent levels of data protection as users or subscribers’ home jurisdiction.

Mobile Push Notifications/Alerts

With users or subscribers’ consent, COMPANY sends promotional and other push notifications to users or subscribers’ mobile device. Users or subscribers can deactivate these messages at any time by changing the notification settings on users or subscribers’ mobile device.
